Nestlé Waters North America's reaction to the lawsuit against the U.S. Forest Service
What is your reaction to the lawsuit against the U.S. Forest Service, which mentions your company?
Several social advocacy groups have filed a lawsuit against the U.S. Forest Service challenging the validity of Nestlé Waters’ special use permit in the San Bernardino National Forest. While Nestlé Waters is not named in this lawsuit, we were disappointed to learn of this action.
As publicly confirmed earlier this year by the U.S. Forest Service, our previously granted permit for the pipeline right of way remains in full force and effect under the federal Administrative Procedure Act. When a permit has been requested by the licensee to be renewed in a timely and sufficient manner, the previously-granted permit does not expire until a final determination has been made by the government agency on the renewal. Furthermore, we take water management very seriously in all watersheds where we operate and feel the claims in the lawsuit don't reflect our responsible stewardship practices within Strawberry Canyon.
We are pleased that the Forest Service has begun the process for the renewal of our permit in San Bernardino National Forest. We understand the community’s interest in the permit review process and that they expect it to be fair, transparent, and consistent with both the law and the science.
